Terms of Use - aerotally

Hi there! Welcome to aerotally, the planespotter's companion. Before you get started, I just want to set a few ground rules. In addition to the End User License Agreement (EULA) provided by Apple, you must read and agree to these Terms of Use.

By using aerotally, you agree to the following terms:

  1. License

    As the creator of aerotally, I grant you a personal, non-exclusive, non-transferable license to use the app on your iOS or iPadOS device. You agree not to reverse-engineer, decompile, or disassemble the app in any way.

  2. Not a Navigation or Safety Tool

    This is the important one. aerotally is an enthusiast's companion and a personal logbook. It is not an aviation navigation, flight-planning, air-traffic-control or safety-of-life application, and it must never be used as one.

    Weather reports, active runway inference, runway headings, live aircraft positions and aircraft details are drawn from third-party and community sources. They may be delayed, incomplete, wrong, or unavailable. Runway identifiers are magnetic while the underlying data is true-referenced; displayed values are for interest, not for operational use. Never make any aviation decision on the basis of anything aerotally shows you.

  3. Access to Data and Services

    aerotally uses third-party services, including the community ADS-B network adsb.lol, aviationweather.gov, adsbdb.com and Wikipedia, as well as my own small service at api.andrecallus.com for active runway inference. These services are used for legitimate use within the app only. You agree not to:

    • Access or retrieve data directly from these services by any means that bypasses the app
    • Attempt to overwhelm them with excessive requests
    • Use automated tools, scripts, or bots to access the service
    • Abuse the service in ways that could harm its availability for other users
    • Attempt to reverse-engineer, intercept, or modify server communications

    These services are provided as a courtesy to improve your experience, and several of them are run for free by volunteers. Abuse may result in restrictions or loss of access.

  4. Responsible Spotting

    aerotally suggests spotting locations and lets you save your own. Suggested locations are provided for information only. You are responsible for where you go and how you behave there: obey local laws, airport security rules, trespass and property restrictions, road rules and any signage. Do not enter restricted areas, and do not do anything that could interfere with airport or aircraft operations. A location appearing in aerotally is not a statement that access to it is lawful, safe, or permitted.

  5. Updates and Modifications

    I reserve the right to update, modify, or discontinue aerotally at any time and for any reason, without prior notice. This includes changes to the app itself, to the bundled data it ships with, and to the services that support it.

  6. App Availability and Issues

    I cannot guarantee that the app or its supporting services will always be available or error-free. Data sources may go offline, servers may experience downtime, and features may occasionally malfunction. If you experience any issues with aerotally, you can reach out at [email protected], and I'll do my best to address them.

  7. Lawful Use

    You agree to use aerotally only for lawful purposes and not in any way that could harm the app, the supporting infrastructure, other users, or any third parties. You are responsible for complying with the laws that apply where you are, including any local restrictions on photographing aircraft or airport facilities.

  8. Content and Information

    The aviation content and information within aerotally - weather, traffic, aircraft records, airport and runway data - comes from third-party and community sources. This content is provided "as is", and I make no warranty of any kind, express or implied, including, without limitation, warranties of accuracy, completeness, timeliness, merchantability, or fitness for a particular purpose.

  9. Your Content

    Your logbook is yours. Sightings, photos, notes, saved spots and sessions belong to you, stay on your device, and sync only through your own iCloud if you have it enabled. I claim no rights over them and have no access to them. You are responsible for the content you create in the app and for keeping your own backups; you can export your logbook to CSV at any time.

  10. User Data and Privacy

    aerotally has no accounts and collects no personal information. All data you create is stored locally on your device. Network requests carry only what is needed to answer them - a coordinate, an airport code, an aircraft registration - with no identifier attached.

  11. Limitation of Liability

    I am not responsible for any loss or damage you may incur as a result of using aerotally, including, without limitation, any loss of data, damage to your device, or consequences arising from third-party content or from acting on information shown in the app. Furthermore, I shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of aerotally or its supporting services.

  12. Third-Party Data and Links

    aerotally displays data from third parties and links to external websites. I do not endorse, verify, or assume any responsibility for the content, accuracy, legality, or availability of these sources. When you open a link in Safari or another browser, you may be subject to the tracking and privacy policies of those websites, which are beyond my control.

    Map data and imagery are provided by Apple Maps and are subject to Apple's own terms.

  13. Intellectual Property

    I own the copyrights and trademarks for aerotally, and you agree not to use my intellectual property in a manner that could harm me or my reputation. Aircraft, airline and airport names and marks belong to their respective owners and are used descriptively only; aerotally is not affiliated with, endorsed by, or sponsored by any airline, airport, aircraft manufacturer or aviation authority.

  14. Service Availability

    The supporting services that provide weather, traffic and active runway data are provided as a courtesy. I reserve the right to modify, limit, or discontinue them at any time. In such cases the app may fall back to bundled data or reduced functionality.

  15. Terms of Use Updates

    These Terms of Use may be updated from time to time. Your continued use of aerotally constitutes your agreement to be bound by the most current version of these Terms of Use.

  16. Entire Agreement

    These Terms of Use, in conjunction with the Apple EULA, constitutes the entire agreement between you and me with respect to your use of aerotally. If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall be enforced to the fullest extent possible.

  17. Acceptance

    By using aerotally, you agree to be bound by these Terms of Use and the Apple EULA.

Fair Use Policy

aerotally is designed for personal, individual use, and it leans on free community services that no one is paid to run. Please treat them the way you'd want them treated.
